A discussion of the elements of financial
exploitation and elder abuse, how to recognize abuse and what are the legal
remedies in the law, both criminal and civil available to our clients.
Further analysis of what is the role of the lawyer as counselor when we see
abuse for our own clients and are we able to help or report given our duty of
confidentiality.

Margaret “Pook” Grathwol
Margaret M. Grathwol is a
partner at Chestnut Cambronne and is known by everyone as Pook (rhymes with
"cook") — the name is a childhood nickname and comes from a rhyme which ended
with "Margaret Mary Pickle Puss" (ask her for the full story). Pook is dedicated
to helping the elderly — in her world, a client in her 70's is young, a client
in his 80's is getting old, and when her clients reach their 90's, she can say
they "have arrived." "I never had a single grandparent when I was growing up. In
fact, I even adopted a few elderly neighbors along the way (thank you Kitty and
Lowell Moody). Today I feel very fortunate to be able to make the lives of the
elderly and their families more peaceful and plentiful."
Pook specializes in probate and trust administration and litigation, drafting
wills and trusts, disability and government benefit planning. Pook is a
graduate of William Mitchell College of Law, cum laude, J.D., 1989, and
University of St. Catherine, B.A. 1984. Her hobbies include: dance, sailing,
gardening, cooking, and quilting. Se habla Español!
David A.
Rephan
David is a partner at Chestnut Cambronne. In his 25 years of
practicing law, he has focused primarily in the areas of elder law, disability
law (including special needs trust law), government benefits law, and veterans
law. He has successfully litigated class actions and individual actions on
behalf of government benefits recipients. David has also participated in
successful legislative initiatives to increase the rights of persons appealing
to the Minnesota Department of Human Services, as well as other rights of
government benefits recipients.
David is a native of Charleston, South Carolina, and has lived in the Twin
Cities for over 21 years. David lives in St. Paul with his partner Jason and
daughters Sarah and Rose. He received his B.A. from Yeshiva University in New
York City, and his J.D. from Touro Law School in Central Islip, New York.
David is a member of the National Academy of Elder Law
Attorneys, and Past Chair of the Minnesota State Bar Association Elder Law
section. He has also taught at numerous legal and community education
seminars.
