In 2023, the Eighth Circuit joined several other circuits in ruling that
chapter 5 avoidance actions can be sold as estate property. See Pitman Farms v.
ARKK Food Co. LLC (In re Simply Essentials LLC), 78 F.4th 1006 (8th Cir. 2023).
Join this IWIRC panel for a discussion of the Simply Essentials decision,
including its rationale and implications going forward. Can the debtor grant its
lender a prepetition security interest in chapter 5 avoidance actions? What does
it mean for the debtor to have an “inchoate” interest in such actions? How does
the Eighth Circuit’s holding compare to the holdings of other circuits? We will
discuss these important issues and more.
There will be a brief Bankruptcy Section business meeting prior to the
CLE.
