CLE.
In
this presentation, we will discuss key terms, new case law developments, and
common issues that come up in bankruptcy cases related to intercreditor
agreements, subordination agreements, and guarantees between and amongst
non-debtor parties. We will cover key considerations for drafting these
agreements and advising your clients on potential liability before entering into
these agreements, as well as the status of case law interpreting the
enforceability of various types of provisions.
