Behind the Headlines - Proposed Amendments to CEQ’s NEPA Regulations

On January 1, the National Environmental Policy Act (“NEPA”) turned 50.  Coinciding with that anniversary, the Council on Environmental Quality (“CEQ”) proposed the first comprehensive amendments to its NEPA regulations since CEQ enacted the regulations in 1978.  The press reports regarding the proposed amendments focused on the amendments’ potential effects on climate change analysis, the reduction in the number of projects requiring environmental review, and the ceding of authority to prepare environmental-review documents to project proposers. This CLE will go beyond the headlines and consider the practical effect of the amendment, explain the reasoning for the changes, and assess their likelihood of withstanding judicial scrutiny if adopted.
