Cooperative Private Divorce: Perspectives on the Proposed Legislation

This CLE will examine proposed Minnesota legislation (HF 1348/SF 1361) to create a cooperative private divorce program and offer perspectives on what the program would mean for those involved in family transitions and the legal system. Specifically, the presenters will discuss:

    • The proposed cooperative divorce program, including
        o Reasons behind the proposed program
        o Basic principles of cooperative private divorce
        o The process to obtain a cooperative private divorce

    • Constitutionality

    • Impacts of the proposed legislation on
        o Dispute resolution in family matters
        o Parenting time and child support
        o Financial issues
        o Real property transactions

    • Self-representation in family matters

    • The role of the courts
