What is litigation funding? What are the legal, policy and ethical issues, and how does it really work? Get an overview from a panel that includes a lawyer with experience in litigation funding and an asset manager from the funding side. Ethics topics will include: whether and in what circumstances litigation funding arrangements may violate Minnesota Rule of Professional Conduct 5.4(a) prohibition on fee-splitting with non-lawyers (including New York City Bar Association opinion on this topic); ABA best practices concerning litigation funding and a lawyer’s ethical obligations (e.g. maintaining client confidentiality, fully advising the client, assuring that client retains control of the litigation, representing the interests of the client and not the funder).
