Minn. Stat § 549.191 limits how and when claims for punitive damages can be brought. At one time, cases in the District of Minnesota unanimously held that the statute applied in federal court. However, over the past few years multiple cases have held that the statute does not apply. Jeff Justman and Josh Jacobson, who have authored dueling articles discussing this issue, will debate whether the statute should apply.
