Collateral Consequences of Criminal Convictions and Expungements

Persons convicted of a crime are generally exposed to a number of legal penalties and disabilities that remain with them long after they have fully served the sentence, even if the record is expunged. This CLE will cover the criminal records landscape including what records exist, where they are located, and how are they accessed. Similarly, this presentation will provide an overview of the expungement statute, the changes to the law since the statute was revised, as well as a review of the process of obtaining an expungement. At the core, the presentation will focus on the common collateral consequences that result from these records.

Josh Esmay | Attorney | The Legal Rights Center

Josh joined the Legal Rights Center in 2016 after serving as the Director of Public Policy and Advocacy for the Council on Crime and Justice. He specializes in helping individuals overcome the burdens of criminal records, as well as training others (e.g. employers, community, and criminal justice personnel) about -- and leading policy advocacy efforts regarding -- the disparate impacts which result from criminal records. Josh graduated from the University of Minnesota Law School after which he began his career practicing in the Ramsey County Public Defender’s office.  He was past-president of the Minnesota Community Corrections Association, the Second Chance Coalition.

Andrea Palumbo | Volunteer Attorney Program Coordinator | Southern Minnesota Regional Legal Services, Inc.

Andrea Palumbo is a creative and solution-oriented private attorney who vigorously represents her clients to achieve their goals and objectives. Andrea guides her clients through the criminal justice system and is an advocate inside and outside the courtroom, working with prosecutors and judges to ensure just results.

M. Graciela Gonzalez is a solo practitioner in criminal defense and immigration cases. She is a graduate of the University of St. Thomas School of Law and the University of Minnesota. She has been a volunteer attorney at the Legal Rights Center for the last eleven years and has been recognized by the Minnesota State Bar Association as a North Star Lawyer for the least several years for her pro bono work. She also volunteers her pro bono services to the Immigrant Law Center and the Advocates of Human Rights.
