An Update on Patent and Copyright Protection for Computer Software

Patent protection for computer software has been in a constant state of flux since the Supreme Court’s Alice Corp. decision in 2014. This seminar will explain the current state of the law on what software is patentable in the United States, and what software is not. We will also consider the latest developments in design patent coverage for software, taking some lessons from the Apple v. Samsung litigation to learn how your clients can benefit from following Apple’s aggressive strategy of design protection for computer software. In addition, we will discuss the latest developments in copyright protection for computer software, including the latest in VFX’s attempt to claim copyright ownership on the output created by its motion-capture software.
