Digital assets are now a “thing” that clients need to
include in their estate plan. The Supreme Judicial Court of Massachusetts
(Ajemian v. Yahoo!) recently ruled that personal representatives may provide
lawful consent on behalf of a decedent to release the contents of online user
accounts. Last month Yahoo! petitioned the U.S. Supreme Court for a Writ of Certiorari, appealing this decision.
Until the dust settles, what can practitioners do? This one-hour presentation will
walk practitioners through RevUFADAA and provide tips on how to assist clients
with digital assets in their planning documents and in probate.
