A business lawyer's failure to properly incorporate U.S. international tax
issues into his legal analysis of a business transaction may significantly raise
his client's tax burden in the United States and even expose the client to
draconian IRS international tax penalties. The probability of a
malpractice lawsuit against the business lawyer increases dramatically in such
situations.
This CLE is intended to provide a plain-language overview of the top five
international tax mistakes that business lawyers make and offer guidance on how
to avoid making these mistakes. The idea is not to simply offer a checklist, but
to supply business lawyers with a conceptual approach that will minimize the
probability of making costly international tax mistakes in the future.
