The Immigration Law Section and The Family Law Section Present: Divorcing the Immigrant: The Intersection of Family and Immigration Law
Divorces can be messy - what can complicate
the matter further is a spouse who is an immigrant. Anytime a spouse has signed
an Affidavit of Support on behalf of their immigrant spouse, that affidavit
becomes a legally binding contract with the United States Government. When the
couple attempts to divorce, there may be continued support which differs from
spousal maintenance. Negotiating a settlement will require an astute attorney to
examine the consequences of the continued obligation on the U.S. citizen
spouse. This CLE examines the cross-roads of the Affidavit of Support and
divorce and offers practice pointers.
Lunch and registration will begin at 11:30 am. The program will begin at noon.
