Hack
back or active defense, depending on how one defines each —and everything in
between— consists of activities that are both lawful and unlawful, and which has
been the recent subject of intense scrutiny, debate, and proposed
legislation. Novel legal theories have been advanced in
support of it, but little case law exists to provide guidance in the absence of
clear legislative intent. Some experts advocate back hacking, and many firms
have resorted to it covertly. This CLE will explore some of these theories, but
also highlight the business and professional risks associated with deceptive
practices that may implicate the Rules of Prof'l Conduct, as well as
misattribution, escalation,
regulatory scrutiny, and civil
or criminal exposures.
The
Computer & Technology Law Section Council will meet at 11:30 a.m.,
follow by lunch and the CLE at
Noon.
