rulemaking experts, Patricia Winget, Dan Lipschultz, and Greg Merz, for a
presentation and panel discussion on rulemaking in Minnesota. Rulemaking is a major undertaking for
any state agency. This topic is
particularly relevant for the Public Utilities Law Section given the recent
rulemaking dockets opened by the Public Utilities Commission.
Patricia
Winget, editor of the Minnesota Rulemaking Manual: A Reference Book for the
Practitioner, is an attorney serving as Rules Coordinator with the Minnesota
Department of Health. She will
present an overview of the Minnesota rulemaking process, including procedures,
legal issues, and standard of review.
As public utility lawyers, Dan Lipschultz and Gerg Merz, will provide
perspective on rulemaking as it relates to the Public Utilities
Commission.
Dan
Lipschultz is a shareholder with Moss and Barnett. He has over 20 years of experience
representing or practicing before the Public Utilities Commission, including a
number of past Commission rulemakings.
Gerg
Merz is a principal with Gray Plant Mooty.
He practices in the areas of commercial litigation and administrative
law, representing clients in rulemakings, contested case proceedings,
investigations, and enforcement actions before governmental agencies, including
the Minnesota Public Utilities Commission, the Department of Human Services, the
Department of Health, and the Board of Medical Practice.
