Foreign entrepreneurs and investors seeking to obtain
immigration status through investment in the United States have many options.
This CLE is intended to provide an overview of a wide range of available
immigration options as well as important business and tax ramifications of these
options.
Mr. Streff will discuss investors visas, such as E-2 and EB-5, and
alternative options for entrepreneurs, such as L-1 intracompany transferees,
EB-1 and O-1 extraordinary ability, and National Interest Waivers’ through the
Entrepreneurs Pathways initiative.
Mr. Vollmers will explain relevant business issues of appropriate entity
formation, business plans, international business relationships, investment due
diligence, and funds tracing.
Finally, Mr. Sherayzen will focus on U.S. international
tax issues relevant to foreign investors in light of each immigration and
business option, especially U.S. tax residency classification,disclosure of
foreign income and foreign assets, and foreign business ownership compliance
requirements.
Presenters:
Mr. Matthew Streff is the principal of Streff Legal,
PLLC, focusing on immigration issues for multi-national foreign professionals,
families, business, entrepreneurs, researchers, and physicians. Streff Legal
also assists with immigration compliance, as well as national origin andother
discrimination issues for employment and higher education matters. Mr. Streff
serves on the Executive Committee for the Minnesota/Dakotas Chapter of the
American Immigration Lawyers Association and the Executive Committee for the
Minnesota Lavender Bar Association. He has provided immigration support to
large, multinational conglomerates, including Fortune500 companies, as well as
small tech and biomedical research start-ups.
Mr. Todd Vollmers an attorney with Thompson Hall Santi Cerny & Katkov,
and is licensed to practice law in Minnesota, North Dakota, the District of
Columbia, and Florida. Todd has extensive international and business experience
having worked in the private sector and in government, and previously served as
General Counsel for a private equity firm with offices in Minneapolis and
Shanghai. Todd also worked as an attorney in the Office of General Counsel at
the U.S. Department of Commerce in Washington, D.C., where he managed legal
issues related to U.S. government advocacy on behalf of U.S. companies with
matters before foreign governments, and foreign trade obligations arising under
the World Trade Organization (WTO) agreements and the North American Free Trade
Agreement (NAFTA). Mr. Vollmers holds a Certificate in Chinese Business Law from
Fudan University Law School, Shanghai, a Master of International Policy and
Practice focusing on International Trade and Economics from The George
Washington University, Washington, D.C., a Juris Doctor from the University of
Minnesota Law School, and a Bachelor of Arts in Political Science from the
University of Minnesota.
Mr. Eugene Sherayzen is the founder and owner of Sherayzen Law Office, PLLC,
which specializes in U.S. international tax compliance for U.S. and foreign
persons, particularly: IRS Offshore Voluntary Disclosure (with its new
streamlined offshoots), FBAR, FATCA, antideferral regime compliance (PFICs and
Subpart F look-through rules), US ownership of foreign business entities
(disregarded entities, partnerships and corporations), foreign trust compliance
and planning (both for U.S. grantors and U.S. beneficiaries), foreign
inheritance, investments in precious metals, complex international tax and
estate planning, and other related issues.
