The personal exemptions granted to debtors under Minnesota state law have grown antiquated in many respects. They fail to take into account changes in values, technology and our collective sense of what constitutes “injury." In the modern era many personal property rights exist that deserve to be exempt from the claims of creditors but are not. This presentation will focus on the shortcomings of Minnesota state personal property exemptions as interpreted by Minnesota bankruptcy courts.
