A clinic requires the participation of volunteer attorneys and volunteer data entry personnel. Volunteers must attend a training session and observe at one clinic prior to volunteering.

*Please note that your volunteer services may be considered gifts to Wills for Heroes clients and could be impacted by statutes regarding gifts to public officials. If you are a lobbyist or lobbyist principal under Minnesota Statutes section 10A.071 (prohibiting certain gifts by lobbyists and principals to certain public officials) or an “interested party” pursuant to Minnesota Statutes section 471.895 (prohibiting certain gifts by interested parties to public officials), you are not eligible to volunteer for any Wills for Heroes events effected by those statutes.* 

Q:  Do volunteer hours for Wills for Heroes clients qualify for CLE credit?

A:  Yes. Under Rule 6 of the Rules of the Minnesota State Board of Continuing Legal Education, a lawyer may claim one hour of standard CLE credit for every six hours of pro bono legal representation that the lawyer provides to a pro bono client referred by an approved legal service provider.  Wills for Heroes is part of the Minnesota Volunteer Attorney Program which is an approved provider under Rule 2T of the CLE Board's rules.  As a result, lawyers providing volunteer service for Wills for Heroes clients may request CLE credit under Rule 6.  There is a maximum of six hours of CLE credit that may be claimed for pro bono representation during a reporting period.  Full information is available on the CLE Board's website at http://www.mbcle.state.mn.us/MBCLE/pages/probono.asp.

Q:  Do volunteer hours for Wills for Heroes clients count towards the MSBA Pro Bono Standard?

A: No. The MSBA Pro Bono Standard acknowledges law practices that commit to provide a certain percentage of annual billable hours on pro bono matters during a given year (1% in the first year, 2% in the second year and 3% in the third year for firms over 100 attorneys).  This Standard was adopted by the MSBA Assembly and is in the process of being implemented by the MSBA Pro Bono Council and the Legal Assistance to the Disadvantaged (LAD) Committee.  Currently, the MSBA Pro Bono Standard references pro bono work as defined under Rule 6(a), (b)(1) and (b)(2) of the Minnesota Rules of Professional Conduct.  Legal assistance provided to the Wills for Heroes program falls under Rule 6(b(3), which is not included in the MSBA Pro Bono Standard.
