The MSBA's Labor & Employment Section Presents


"When is Adverse Action Adverse Enough to be Actionable?"

Join Howard Bolter and Adrianna Shannon to discuss some troublesome questions in the “adverse action” analysis, such as:

  • When is a failure to hire or promote actionable?
  • What is the doctrine of futility?
  • When is a charging party “constructively discharged”?
  • What is “tangible” adverse employment action?
  • Is a hostile work environment an adverse action?
  • Are denials of certain benefits, leaves, or training opportunities actionable?

Discuss these and other questions with your colleagues and presenters.
