The MSBA's Labor & Employment Law Section Presents
"Hurt Locker Meets the Workplace"
As U.S. military involvement in Iraq and Afghanistan winds down, employers will be increasingly called on to assist employees in dealing with the lasting impacts of those engagements.
This November, the EEOC held a hearing on employment discrimination against veterans with disabilities, suggesting that this issue will become a new focus of enforcement. And although employers are generally familiar with the ADA’s accommodation requirements, few understand that the Uniformed Services Employment and Reemployment Rights Act (USERRA) also guarantees veterans the right to accommodation, even if they are no longer qualified to perform their former jobs due to service-related injuries. At the same time, Congress has expanded the FMLA to allow employees additional time off to care for family members injured during military deployments.
This presentation will provide an overview of the legal landscape relating to disabled service members, including a discussion of recent court decisions and the results of the EEOC’s recent hearing.
