The MSBA's Food and Drug Law Section Presents


"The FCA and the FDA: Testing the Boundaries of Qui Tam Law"

The past two years have been a time of great upheaval for the False Claims Act and the lawyers and courts who must apply it. The economic downturn has ignited a chorus of calls for politicians to be tough on companies who engage in fraud. These cries have resulted in two major amendments to the statute, giving it a broader reach and impact than at any other point in history. At the same time, the Supreme Court has issued a series of important decisions attempting to cabin the FCA within the bounds of reason. From the Supreme Court's Allison Engine decision in June 2008, to the enactment of the Fraud Enforcement & Recovery Act in 2009, the Patient Protection & Affordable Care Act of 2010 and the Supreme Court's March 2010 decision in Graham County, Congress and the courts have been waging a pitched battle against each other to define the boundaries of civil health care fraud. The presenters will review these tumultuous developments and discuss how they have applied to recent cases involving alleged off-label violations of the FCA. They will also discuss the local criminal case United States v. Guidant LLC.
