"Linking the Particular Features of Domestic Violence in a Custody Case to Parenting and to the Child's Needs and the Family Law Section's Annual Meeting"

The presence of domestic violence in a family law case can have varying implications for child custody - ranging from none to extremely serious - depending on the features of the violence. Recent research, including a project based in Minnesota, explores the difficulties faced by many legal and custody practitioners who need to do determine how, if at all, the abuse should factor into custody arrangements. Participants in this session will be better able to determine how to link the features of the abuse (especially coercive control) to the parenting of both parents.

Speaker:

Loretta M. Frederick, J.D. , Senior Legal and Policy Advisor for the Battered Women's Justice Project

Ms. Loretta Frederick serves as Senior Legal and Policy Advisor for the Battered Women's Justice Project, a national resource center on domestic violence legal issues. She is currently engaged in a national project on child custody and domestic violence funded by the U.S. Department of Justice. She serves as faculty for the National Judicial Institute on Domestic Violence and over the past thirty four years has designed and given presentations at hundreds of educational sessions worldwide for prosecutors, judges, attorneys, advocates, law enforcement officers, and police chiefs. Since 1978, when she co-founded the Women's Resource Center of Winona, Ms. Frederick has provided training, legal consultation, and assistance with litigation and policy development on domestic violence issues for legal system practitioners.

She assisted in drafting the Model State Code on Domestic and Family Violence in conjunction with the National Council of Juvenile and Family Court Judges and served for three years as a consultant for the U.S. Marine Corp on the development of its coordinated community response to domestic violence. Her work has included assisting non-governmental organizations and governments in many countries around the world to improve their legal system's handling of domestic violence cases. She is past chair of the Family Law Section of the Minnesota State Bar Association's Law Section and of its Domestic Abuse Committee. Loretta began her work as an attorney with Southern Minnesota Regional Legal Services.
