The technologies that generate information are ubiquitous and constantly changing. While it is not required that practicing attorneys possess all the technical knowledge of a computer expert, IT director and private investigator, it would certainly be helpful in today's ever shifting digital landscape. It remains imperative for counsel to continually refine and update their knowledge of information systems with 99% of information now being electronically generated. Today's lawyer must either acquire sufficient knowledge of ESI, or associate with the requisite talent, if one is to fulfill the obligation to represent clients competently. While perfection is not required what is required is that counsel be educated regarding the data held by their client, its relative accessibility as well as the nature of the information contained.
