The MSBA's Antitrust Section Presents
"Pay-for-Delay Agreements In the Pharmaceutical Industry, and Recent Legislative and Executive Branch Initiatives"
Professor Hemphill, whose research focuses on antitrust, will discuss pay-for-delay agreements used by brand-name drug makers to delay the launch of generic copies. Whether these agreements violate the antitrust laws is a subject of continued debate and conflicting court decisions. Professor Hemphill will examine the arguments for and against such agreements, new evidence about their frequency and cost, and ongoing efforts by the FTC, DOJ, and Congress to curb their use.
