Required Without Pay: Deconstructing Integrity
Staffing v. Busk’s Impact on Preliminary and Postliminary Work
Last December the U.S. Supreme Court unanimously held that
the Portal-to-Portal Act did not require an employer to compensate employees for
time spent in security screening lines at the end of their shift. The
Court reasoned that—even though the employer required the screenings, benefited
from the process, and could have made the screening less onerous—the activity
nonetheless qualified as a non-compensable postliminary act exempt from the Fair
Labor Standards Act because it was not “integral or indispensable” to the
employees’ “principal work activities.” This CLE will examine

potential impact on the compensability of
other required, preliminary and postliminary work.
