I Want My Record Back! How Artists Can Terminate Record Company Copyrights in Sound Recordings

Under the Copyright Act of 1976, any grant, license or assignment made on or after January 1, 1978 may be terminated by the author thirty-five years from the date of such transfer if the work was not originally created as a work-made-for-hire for an employer. Given the unequal bargaining power at the time of early transfers and the impossibility of determining a work’s value until after it has been exploited, the intent of Congress is to safeguard authors against unremunerative transfers. With transfer termination dates beginning January 1, 2013, the potential impact of the 1976 Act on music recording and publishing companies is massive. Tim Matson will analyze the statute, including termination notice filings and other technical complications related to the interpretation and implementation of the 1976 Act.

Tim Matson has over 20 years of experience representing musicians, filmmakers, media talent, writers, visual artists and other creators of artistic works in all aspects of their entertainment careers as a transaction lawyer and litigator. He has worked with major legacy artists on copyright transfer termination issues, including the firm’s filing of the nation’s first post-1978 notice of termination.  He served as Chair of the Minnesota State Bar Association Arts & Entertainment Law Section from 2003 to 2004. Tim has twice been listed as a Rising Star by Minnesota Super Lawyers, and is AV rated by Martindale-Hubbell.
