On February 25, 2015, the Bureau of Indian
Affairs published its revised BIA Guidelines for State Courts and Agencies in
Indian Child Custody Proceedings – the first such update since guidelines were
issued over 35 years ago. The new guidelines propose dramatic changes to
previous guidelines. ICWA attorney Mark Fiddler will discuss what’s new, what’s
a departure from previous guidelines, and various takes on their legal status.
This is a must for any attorney or judge who handles ICWA cases.
Mark Fiddler is an adoption attorney,
founder of the Indian Child Welfare Act Law Center, current Co-Chair of the ICWA
Committee for the American Academy of Adoption Attorneys, and was co-counsel for
adoptive parents in Adoptive Couple v. Baby Girl, 133 S. Ct. 2552 (2013), a
landmark case which spurred development of new guidelines.
