In North Carolina
State Board of Dental Examiners v. Federal Trade Commission, the U.S.
Supreme Court ruled that efforts by the North Carolina Board of Dental Examiners
to prevent dental hygienists from engaging in the practice of teeth whitening
are not immune from antitrust attack under the "state action" doctrine.
The Court found that where a medical board that has a “controlling number” of
“active market participants,” the board cannot readily rely on state action
Immunity unless the state engages in “active supervision” of the board’s
activities. How “active supervision” might occur remains to be seen.
Here in Minnesota, the case raises the issue of whether its various health
boards are entitled to state action immunity. The Health Law Section is
pleased to have Jack Nichols, who represented the North Carolina Dental Board in
this case, along with Greg Merz, who represents health care providers in matters
involving state regulatory boards, present on this case.
