Appearing in Arbitrations Outside of Minnesota: Avoiding Unauthorized Practice and Navigating the Patchwork Regulation Enacted by Other States.

Even the smallest construction law client can be forced to arbitrate a dispute outside of Minnesota.  Practicing law in a jurisdiction where you are not licensed can constitute the unauthorized practice of law resulting in ethics complaints, forfeiture of fees, contempt sanctions, and even criminal exposure.  While many states take a laissez faire approach towards policing unauthorized arbitration practice, more states are enacting rules imposing specific admission requirements for arbitration practice by out-of-state lawyers.  Join Dorsey’s Ethics Partner and former Director of the Office of Lawyers Professional Responsibility as he discusses arbitration appearances in states outside of Minnesota and how to avoid unauthorized arbitration practice.
