Ditches in Minnesota were a political no-fly zone until
Governor Mark Dayton declared in 2015 a major new policy effort to ensure all
drainageways in the state – as well as lakes and creeks – were bordered by
vegetated buffers. Since then property owners, local government staff, state
agency representatives and legislators have rushed into action, attempting to
simultaneously improve and implement the legislation. Requirements for lakes and
creeks became effective late last year, while ditches must be buffered by
November 2018. Tom Gile from the Rochester office of the Board of Water and Soil Resources and Michael Welch, an attorney with
Smith Partners in Minneapolis, will provide an overview of the legal framework and progress
made on the ground around the state on the
rollout of the law.
