Ethical Issues in Construction Law
Practice
This Presentation will be a
hypothetical-based, audience participation program exploring several different
ethical issues arising under various Rules, including 1.4 (communication), 1.7
(conflicts), and 5.1 – 5.2 (responsibilities of supervisory vs. subordinate
lawyers). Chuck Lundberg, a nationally recognized ethics expert, has
presented numerous programs like this for law firms and bar groups and received
rave reviews. Construction law practitioner Tom Radio will also be on the
panel to provide a practical approach on how ethical issues can arise and be
correctly dealt with in a real-life context.

This session will review professional obligations
for contractors on public works projects. We will examine the relevance of
ethics in today’s society, provide statutory requirements and review salient
case studies from recent events to highlight the import of understanding the
obligations required by state law, court precedent, and professional codes of
conduct.

Kubes
Kristine A. Kubes, Esq. of Kubes Law Office, PLLC
will discuss the ethical standards applicable to professional engineers and
architects, and the legal ramifications of these standards and violations of
these standards in the context of the professional liability of design
professionals and their ability to practice under Minnesota law. Ms. Kubes
served on the MN Board of AELSLAGID from 2005-2013, during which she served two
terms as Board Chair.

Ethical Issues and Advocacy – What is and is not
appropriate from the ethical perspective
This presentation will provide a review and analysis
of the ethical rules that apply to dispute resolution in or outside a
courtroom. Issues that will be covered include duties of competency,
diligence, honesty, candor, confidentiality and privilege, and fairness.
There will be a discussion of the conflict between the duties owed to the client
and the duties owed to the court and the judicial
system.
