As lawyers, our duty of
confidentiality provides the cornerstone of our relationships with our
clients. We’ve grown accustomed to quiet withdrawals, transfers of
representation, and doing our best for our clients and former clients even when
they’ve not been at their best. Our duties as zealous advocates can put us in
the line of fire of difficult parties and opposing counsel, while requiring us
to maintain the integrity of the profession and respect the rights of others.
The practice of law has always required customer service skills and a measure of
resilience. Social media has opened new avenues for clients and lawyers to
complain and
blow off steam, necessitating enhanced resiliency and communication
skills. This one hour ethics CLE explores how lawyers inadvertently (and sometimes not)
can run afoul of duties of confidentiality, exceed the limits of
zealous advocacy, and otherwise engage in misconduct in
the forum of social media, and the tools lawyers
can employ to meet the challenges of
modern law practice.
