This session is designed for attorneys in private practice
and for Assistant Attorneys General or County Attorneys who appear before
Administrative Law Judges at Office of Administrative Hearings in contested case
hearings under the Minnesota Administrative Procedures Act. The
presentation will include a step-by-step description of each stage of a
contested case hearing, from the Pre-Hearing Conference to the submission of
written Exceptions or Argument to the final agency decision maker. In
addition to a refresher on OAH’s procedural rules governing contested cases, you
will learn helpful practice tips from three different viewpoints: from the ALJ,
the agency decision maker, and a private practitioner.
The panel will discuss the effective use of
discovery and motion practice, as well as how to build a persuasive case in
chief. We’ll also identify pitfalls to avoid throughout the contested case
process
