Symposium on the Sufficiency of
the Evidence in Criminal Cases:
The Standard of Appellate Review for Convictions Based On Direct and Circumstantial Evidence,
Jury Instructions, and the Conduct of Criminal Trials
This four hour CLE has two segments. The
appellate segment is devoted the sufficiency of the evidence standard of review
in criminal appeals, the viability of having a traditional and circumstantial
evidence standard of review, and whether the jury should be instructed on the
difference between direct and circumstantial evidence. The trial segment
will focus on the implications of these appellate issues for the conduct of
criminal trials. Topics of discussion for the trial segment will be the
difference between direct and circumstantial evidence, whether juries should be
instructed on the difference between direct and circumstantial evidence, and how
such an instruction would impact criminal trials and trial strategy.
This program is jointly sponsored by the MSBA’s
Appellate Practice and Criminal Law Sections.
