On June
15, 2012, the Secretary of the U.S. Department of Homeland Security (DHS)
announced that certain people who came to the United States as children and meet
several guidelines may request consideration of deferred action for a period of
two years, subject to renewal. Deferred Action for Childhood Arrivals
(DACA) is a discretionary grant of relief by DHS that provides a two (2) year
reprieve from deportation for certain undocumented youth living in the United
States. As of March 2014, more than 673,000 people had applied for DACA,
and 553,197 were approved.
On June 5, 2014, DHS Secretary Jeh Johnson
announced the process for individuals to renew enrollment in the DACA
program. Renewal of DACA ensures current DACA holders will continue to be
safe from deportation for another two-year period. In addition, they will
continue to have work authorization and to be eligible to receive a social
security number, and, in nearly every state, a driver’s license.
This CLE will explain the renewal process in
general, including the eligibility requirements for renewal, timing of renewal,
the evidence needed to support a renewal application and misconceptions that
might arise surrounding DACA program renewal.
