This basic level seminar will provide a guide to criminal
law attorneys regarding their responsibilities in representing clients who are
not U.S. citizens after the U.S. Supreme Court’s decision in Padilla v.
Kentucky. What are some of the
basic terms, such as: what is the
difference between deportable and removable? What key items do you, as the criminal
law practitioner, need to be aware of in representing clients on: misdemeanor
domestic assault charges, felony level criminal cases, DWI’s, and what should
you avoid saying, if possible, when making a factual record in court? Is getting a client’s record expunged
after the fact helpful? Can your
client enter Canada as a visitor if he has a misdemeanor DWI conviction, and are
there any special programs that can enable your client to go North if he has a
DWI conviction? Practical examples
will be provided.
Immediately following the CLE, join members of the Criminal Law
and Immigration Law Sections for a social hour. Drinks and appetizers
will be provided.
