Implications of Adoptive Couple v. Baby Girl

Adoptive Couple v. Baby Girl, 570 U.S. ___ (2013), is a decision of the United States Supreme Court holding the Indian Child Welfare Act does not bar the termination of a biological father’s rights who never had physical or legal custody of the child, and otherwise had no standing under state law to block the adoption of his child. This decision has wide-ranging implications for adoption, third-party custody, and foster care and termination proceedings involving Indian children.  Join us for a discussion on the case and the possible implications for your practice.

Mark D. Fiddler, Fiddler Law Office, P.A.

 

Mark Fiddler is one of the lead attorneys for the adoptive parents in Adoptive Couple v. Baby Girl. Mark is a fellow in the American Academy of Adoption Attorneys, and founded the Indian Child Welfare Act Center in Minneapolis in 1993. He’s been appointed to the Minnesota Supreme Court Task Force on Foster Care and Adoption, the Minnesota Supreme Court Child Protection Rules Committee, the Minnesota Supreme Court Expedited Juvenile Appeals Rules Committee, the DHS Blue Ribbon Adoption Committee, and the State Court Bench Manual Committee on Indian Child Welfare Act. He has litigated several ICWA cases in Minnesota appellate courts and serves as co-counsel to attorneys in ICWA cases throughout the United States. Mark is a 1988 graduate of the University of Minnesota Law School and is a proud enrolled member of the Turtle Mountain Band of Chippewa Indians.
