With the passage of new
Best Interest Factors, it is appropriate to discuss standards for custody
evaluations which would provide greater uniformity and promote better practices
for those who conduct these evaluations. This presentation will focus on how
evaluators can provide helpful and effective evaluations so that parents,
attorneys and the court have reliable information to use in making decisions
about custody and parenting time arrangements that benefit children. We will look
at the multiple methods used in evaluations, the sources of data that are necessary,
how that data is analyzed and synthesized, and how recommendations are
formulated.
The Family Law Section membership will
meet prior to the CLE at 9:30 a.m.

Mindy F. Mitnick, EdM, MA | Licensed
Psychologist
Mindy F. Mitnick is a Licensed Psychologist practicing in
Minneapolis. She received a Master of Education from Harvard University and a
Master of Arts from the University of Minnesota. She specializes in work
with families in the divorce process and with victims of abuse and their
families. Ms. Mitnick has trained professionals throughout the US and Canada in
identification and treatment of child abuse, the use of expert witnesses in
child abuse and divorce cases, effective interviewing techniques with children,
interventions in high-conflict divorce and the impact of psychological trauma.
She has been a speaker for the National Child Protection Training Center,
National Center for Prosecution of Child Abuse, the Association of Family and
Conciliation Courts, Office of the Children’s Lawyer in Canada, the American
Academy of Matrimonial Lawyers and numerous statewide multidisciplinary training
programs. Ms. Mitnick has written and taught extensively about the assessment of
child sexual abuse allegations during custody disputes. Ms. Mitnick served as a
member of the Minnesota Custody Dialogue Group that rewrote the state’s Best
Interest Factors and as a member of the AFCC Task Force on Court-Involved
Therapy. She has been elected as Treasurer and continues to serve on the Board
of AFCC.
