This program will focus on the Supreme Court's recent
opinion in United Health Services v. U.S. ex rel. Escobar and the effect it is
expected to have, and has had thus far, on other federal False Claims Act (FCA)
cases. Does the Escobar decision simply confirm the validity of the
implied certification theory, as Department of Justice officials have
suggested? Or does it set a new, higher bar for relators and the
government in these cases, as many in the defense bar have asserted? And
what types of FCA cases will be most impacted under either interpretation of the
law? The presentation will explore these and similar issues relating to
the future of the false certification theory in health care cases.
