Corporate wellness programs have been an area of particular focus for the
EEOC in recent years. The EEOC has initiated several lawsuits challenging
programs that it contends violate the Americans with Disabilities Act and the
Genetic Information Nondiscrimination Act. In addition, the EEOC issued
proposed regulations in 2015 setting the circumstances under which such programs
may be deemed to comply with the ADA and GINA. Those regulations could be
finalized in 2016. EEOC Senior Trial Attorney Laurie Vasichek and
FaegreBD employment litigation partner Chuck Knapp will present on the status of
the EEOC's efforts in challenging wellness programs, and what employers likely
can expect to see in the final regulations.
