The Section’s Venue Committee will present its report on "Venue Fairness".
The report describes the practice of filing most substantial chapter 11 cases in Delaware
or the Southern District of New York under the current venue statute
even though these companies do not have their headquarters or substantial
assets in those districts. It reviews such filings by Minnesota based
companies. It discusses the evolution of venue statues, rules, and practices over
time. The report discusses proposed changes in the statute which have been introduced in
Congress or may be in the future.
Please note the Section will be voting on
the Venue Committee's report and proposed resolution at this
meeting.
