Privacy Dilemmas in Elder Care: Perspectives for Attorneys of Providers, Patients and their Families

Under the Minnesota Patients’ Bill of Rights, patients/residents are afforded broad privacy rights related to their treatment and personal lives. Hospitals, nursing homes, and other facilities often confront complex issues when evaluating what information can be shared, when, and with whom.  Multiple federal and state laws may be relevant, combined with an array of other factors such as diminished capacity, intra-familial conflict, and emergency events. Furthermore, providers may be sifting through competing legal documents like health care directives, power of attorney forms, and guardianship/conservatorship orders. 

The Elder and Health Law Sections have assembled three panelists - each representing a different perspective - to analyze these dilemmas in the context of hypothetical scenarios. The program will be moderated by an experienced elder law attorney and bring together the insight from a law school professor, provider-side health care attorney, and a licensed social worker practicing in senior care.  The purpose of this dialogue is not to arrive at concrete answers, but to provide attendees with the legal tools and perspective to thoroughly analyze the issues. 

Please join us for this valuable discussion important to any elder or health care practice.  Breakfast begins at 7:30 a.m., followed by the program from 8:00 - 9:00 a.m.  Special meal requests need to be received no later than Tuesday, March 15.
